Cancellation Policy, Liability Release, Waiver and Photography Release

Cancellation Policy

If you cancel 90 days or before workshop inception, you will receive a full refund of the deposit or full payment paid.

If you cancel less than 90 days prior to workshop inception, and if you have paid for the workshop in full, we will make every effort possible to issue a full credit towards another open workshop. If you have paid only a deposit, the deposit will be refunded only if we can fill the spot prior to the beginning of the workshop.

Liability Release, Waiver, and Photography Release

IMPORTANT: In order to participate in the selected Mike Shaw Photography, LLC, workshop (Workshop), we require all participants (Attendee) to digitally agree to this Liability Release and Waiver. Please read this information and check the “I Accept” box during checkout to accept the terms. By clicking the “I Accept” box, you are providing your electronic signature.

1) Mike Shaw Photography, LLC, our instructors, guides and cooperating agents aim to provide every participant a safe, educational and enjoyable experience. We assume no liability for any act, error, omission, illness (including viruses or illness from any communicable disease) injury (including death), loss, delay, mishap, or damage to Attendee, persons or property arising from any cause during the course of the Workshop or in transit thereto. We accept no responsibility for losses to Attendee or additional expenses to Attendee due to delay or changes in the services to be provided. We reserve the right to change our arrangements should conditions necessitate, or to cancel any aspect of the Workshop.

2) In the event that we deem it necessary to cancel the Workshop we will provide a full refund, which the participant acknowledges as full and final settlement.

3) I (Attendee) understand there are inherent risks and hazards associated with activities in the Workshop. I certify that I am physically fit and capable of participating in this Workshop, and I am fully and completely aware of any associated risks, including but not limited to those created by outdoor day or night field locations, and weather.

4) I agree that I assume full and complete responsibility for my activities, including photography, hiking, walking, and observation done outside of the regularly scheduled Workshop hours, including off-site activities.

5) I will assume and pay my own medical and emergency expenses in the event of an accident, illness or other incident to and arising from my participation in this Workshop. I give permission for emergency services to be given should it be deemed necessary.

6) Mike Shaw Photography, LLC, will assume no liability for injury (including death), illness (including viruses or illness from any communicable disease, including COVID-19 of any variant), or loss of personal property or expenses thereof associated with Workshop participation.

7) I (Attendee) agree to pay all damages to property or persons which may arise from my participation in this Workshop and I will indemnify, defend and hold harmless Mike Shaw Photography, LLC, for such damage.

8) By joining this Workshop I acknowledge that I have read the above information concerning responsibility and release for myself, my heirs and assigns Mike Shaw Photography, LLC, their guides, instructors and any cooperating agent from any and all claims, demands or cause of action for damages, liability or injury that I may have against them incident to or arising from my participation in the Workshop.

9) I grant full usage rights to Mike Shaw Photography, LLC, to use, for promotional, commercial or fund-raising purposes, any photo taken during the Workshop in which I / my equipment appear and waive any claims for financial reimbursement for said use. I specifically waive and release for myself, my heirs and assigns, from any and all claims, demands or cause of action for payment arising from my participation in the Workshop, including the use of my image or equipment for use in any film, video, TV, photos or other promotion which may result in income by the producer of said media.

10) I represent that I am over the age of 18 and that I agree to the above terms and conditions.
